THIS DOCUMENT SETS FORTH THE TERMS OF USE FOR THE CANEBOOKS.COM, INC., “CANEBOOKS”, WEBSITE WWW.CANEBOOKS.COM, “SITE”. PLEASE READ THE FOLLOWING TERMS OF USE CAREFULLY. BY USING THE SITE, YOU, THE USER, “YOU”, INDICATE THAT YOU HAVE READ AND AGREE TO BE BOUND BY THESE TERMS OF USE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT USE THE WEBSITE IN ANY MANNER.

1. Site Ownership. In registering with CaneBooks, we grant you a limited license to access this Site for your personal use only. Any commercial use for data collection and/or profit is not allowed without prior written consent of CaneBooks. Furthermore, all materials on this Site, including images, illustrations, algorithms, and other coding are owned or licensed by CaneBooks. You may not reproduce, perform, create derivative works from, republish, upload, post, transmit, or distribute any portion of this Site, in any way whatsoever, without the prior written consent of CaneBooks. The Site is the property of CaneBooks and all rights, title and interest in the Site shall remain with CaneBooks.

2. Hyperlinks are Not Endorsements. Any link from the Site to a non-CaneBooks website does not mean that CaneBooks endorses or accepts any responsibility for content. When you click on a link you enter at your own risk. It is your responsibility to take precautionary measures when clicking on links or exploring the web to ensure that the websites are virus free and without material of a destructive measure.

3. Transaction Disclaimer. CaneBooks connects students online to facilitate the buying and selling of used textbooks. CaneBooks is not responsible for the transaction that ensues after the buyer is put into contact with the seller. CaneBooks does not guarantee that you will successfully buy or sell a book. Users are responsible for arranging a place and time to meet, and for the exchange of the textbook for money. Users are advised to meet in a public place on campus. Users are responsible for any disputes that arise from transactions and resolving them amongst themselves. CaneBooks is not liable for any problems that might arise after the Purchase Confirmation e-Mails with the other party's contact information were sent. The service that CaneBooks provides is solely to link two students' contact information, not to provide a safe transaction. The user of CaneBooks is totally responsible for arranging a safe meeting.

4. Representation Disclaimer. CaneBooks does not screen any users nor does it review any books or information posted on the website by users. The accuracy of listings is the buyer’s and seller’s responsibility. Any illegal or discriminatory postings do not reflect the views of CaneBooks. CaneBooks is only a forum and users assume all risk and responsibility for their postings.

5. Warranty Disclaimer. All information posted on the Site is posted “AS IS”. CaneBooks makes no express or implied warranties of any kind as to the quality, condition, accuracy, completeness, and validity of any postings on the Site. CaneBooks does not warrant that the functioning of the website will be error free or uninterrupted or that errors will be corrected.

6. Indemnification. By using this website and/or posting information, you agree to indemnify CaneBooks, its officers, directors, employees, agents, distributors and affiliates for any and all claims, damages, losses and causes of action arising out of your breach or alleged breach of this agreement.

7. Site Use Restrictions. You will not post on or transmit to the Site any false, defamatory, obscene, destructive, pornographic, profane, threatening, or unlawful materials, or otherwise violate any law in your use of the Site. You will not modify, copy, distribute, transmit, reproduce, publish, transfer, sell, lease, rent, sublicense or give away any information obtained from the Site. You will provide accurate registration information and ISBN and condition information. You must have in possession the book you wish to sell and you must attempt to complete the transaction to the best of your ability.

8. Terms of Use Change. CaneBooks reserves the right to change or modify in any way these Terms of Use without prior notice and is not responsible for notifying you of these changes. All changes are effective immediately after they are made and your continued usage of the Site will mean that you accept these changes.

9. Termination. CaneBooks may, in its sole discretion, terminate or suspend your access to all or part of the Site for any reason. In the event this agreement is terminated, the restrictions regarding information appearing on the Site, and the representations and warranties, indemnities and limitations of liabilities set forth in this agreement shall continue.

10.Feedback is the Property of CaneBooks. Any comments or material sent to CaneBooks, including but not limited to, questions, comments, feedback, ideas and suggestions, become the property of CaneBooks upon receipt. CaneBooks is not responsible for the confidentiality of any information communicated to CaneBooks. By sending information to the CaneBooks Site, you are granting CaneBooks a royalty-free, perpetual, unrestricted license to publish, transmit, perform and display the information for any purpose, including, but not limited to, advertising and promotional purposes.

11.Jurisdiction. This Site is controlled and operated from Miami, Florida. CaneBooks does not claim that materials posted on the Site are appropriate or available for use in other locations. If you choose to access this Site from other locations, you do so at your own risk and are responsible for compliance with any and all local laws. This agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any action brought to enforce this agreement or matters related to the Site shall be brought in either the State or Federal Courts of Miami-Dade County, Florida. If any provision of this agreement is deemed void, unlawful or otherwise unenforceable for any reason, that provision shall be severed from this agreement and the remaining provisions of this agreement shall remain in force. If any condition of this agreement is deemed too restrictive, that condition will be changed to the most restrictive possible condition that the court will allow and will remain in full effect.

12.Affiliation. CaneBooks is not affiliated in any way with the University of Miami. No work on this Site was done on University of Miami property or with University of Miami funds.
